Compliance Requirements for DOT Owner Operator

As an owner-operator, you must meet DOT and FMCSA drug and alcohol testing requirements if you meet any of the following criteria:

• Gross Vehicle Weight (GVWR) or Gross Train Weight (GCWR) 26,001 lbs. or more

• Transportation of 16 or more passengers

• Shipping hazardous materials that require labels

Review of FMCSA Rules Part 382 shows that the Department of Transportation (DOT) requires owner-operators to be part of a DOT coalition requiring pre-employment, accident, post-accident, and reasonable suspicion/causing drug and alcohol testing for the safety of sensitive workers (driver). All owner-operators must comply with Part 382 of the Code of Federal Regulations: Controlled Substances and Alcohol Testing Program. As a member of the goMDnow FMCSA Alliance, you can ensure that you are in compliance.

As a new owner-operator, you must pass a new entrance exam within 18 months of receiving a DOT work permit. This inspection will include checking your compliance with drug and alcohol testing rules.

With our FMCSA alliance, you'll avoid the common problems we see:

• There is no owner-operator drug or alcohol testing program for a driver.

• Inappropriate drug testing with providers who do not understand DOT drug and alcohol testing rules.

• No Random Drug Testing Coalition - Owner Operators need a DOT Random Drug Testing Coalition.

• Lack of pre-employment drug testing

Our plans are available in all regions of the United States. Ensure compliance with DOT and FMCSA requirements. Join our goMDnow Owner Operator DOT Random Affiliate Program today!

Failure to comply with FMCSA Part 382 may result in violations and fines ranging from $250 to $10,000 per violation. In many cases, your work permit may be revoked. This is a safety procedure; do you follow it?
