What is 49 CFR Part 382?

49 CFR Part 382 is a part of the Federal Motor Carrier Safety Regulations (FMCSRs) that apply to commercial motor carriers and drivers. It establishes the rules and procedures for testing commercial drivers for alcohol and controlled substances, such as marijuana, cocaine, opiates, amphetamines, and phencyclidine (PCP). 

It also specifies the prohibitions, consequences, and responsibilities for drivers and employers regarding alcohol and drug use


Who is Subject to 49 CFR Part 382?

49 CFR Part 382 applies to any driver who operates a commercial motor vehicle (CMV) in interstate or intrastate commerce, and who is required to have a CDL. A CMV is defined as a vehicle that:

  • Has a gross vehicle weight rating or gross combination weight rating of 26,001 or more pounds; or

  • Is designed to transport 16 or more passengers, including the driver; or

  • Is used to transport hazardous materials that require placarding
